June 4th @ 10:00 AM 10% Buyer’s Premium Online, 7% Live Onsite Buyers Terms: Real Estate: The buyer is required to pay ten (10%) percent of the purchase price on the day of sale. Online Winning bidders will be required to Pay ten (10%) percent of the purchase price no later than close of business day June 6th, 2022. The balance to be paid on or before July 5th, 2022, or due diligence, when deed and possession will be given. A Seven (7%) percent Buyer’s Premium will be added to the highest and best bid by live onsite bidders, a ten (10%) Buyer’s Premium will be added to the highest and best bid by Online Bidders, and will be paid by the buyer at the closing as part of the consideration. Online bidders must contact our office and be preapproved to bid online with in 48 hours of auction day. Any bidder wanting to bid after 48 hours will be charged $5000.00 fee on credit card for approval for said sale. In the event you are not the winning bidder, you will be credited back the approval fee. Auction Terms & Conditions We have been authorized and directed by Dick and Foster Ratliff, Exactors for the Estate of Margaret Ratliff, to offer for sell at Absolute Auction, This 3 bedroom, 2 ½ bath, kitchen, living room, dinning room, den, full basement, screen porch, all located in the Woodlands Block C, Lot 11 in Frankfort, Franklin County Kentucky. The Property is being sold in accordance with and subject to all easements, conditions, restrictions, and covenants now of record or apparent from an inspection of the property, and is being sold, “As-Is”. All advalorem taxes for and in the year 2022, shall be prorated to the date of closing and delivery of deed. Neither the sellers, nor the selling agents, know of any material or latent defect in the property. No inspection of the property has been made to certify the non existence of termites or other wood infestation. No inspection or testing has been conducted to detect the existence of radon, asbestos, lead base paint, or any hazardous materials on the premises. No mechanical tests or inspections, where applicable, have been conducted in regard to plumbing, electrical, heating and cooling systems, or fixtures. As stated in previous advertising, all prospective buyers would have no less than ten(10) days prior to the date of sale to have the subject property inspected for the possibility of lead base paint. At this time the sellers, nor the selling agents, know of no prospective buyer requesting this testing to be done during the mentioned time frame. Therefore, the successful bidder shall sign a waiver, along with these terms, stating that they have not had lead base paint testing performed, and have no knowledge of lead base paint being in existence on or at the subject property. Insurance: The home or dwelling is currently insured. This insurance shall be kept in full force and effect, by the seller, until date of closing and delivery of deed. The purchaser, at their own discretion, may purchase additional insurance to suit their needs. First party or sellers agree to execute and deliver to second party or buyer, a good General Warranty Deed for said property, on or before July 5th , 2022, or due diligence. If the sellers can not convey an unencumbered title to the real estate, or if the property shall not be marketable, then the selling agent, Greg Howard Auction Service, Gatewood and Associates Realty , will refund to the buyer the sum this date paid, and the same shall be accepted by the buyer in full satisfaction of all claims and demands of the buyer arising or in any manner growing out of this agreement, and thereupon this agreement shall be null and void, and the sellers and buyer will be released from the obligation thereof. This agreement shall inure to the benefit of and be binding on the heirs, successors, assigns, administrators and executors of the parties hereto. IN ORDER TO BID ONLINE, Successful Online bidders will wire or have delivered funds for the contract price as earnest money along with a signed real estate contract. All REGISTERED BIDDERS will be charged $1.00 to authorize their credit card upon registering for the auction. This $1.00 is just a hold and it will be refunded onto your card. Registered bidders must have or been preapproved bank letter of credit prior to or during the bidding period. The bidders account may be suspended or turned off if the bank letter of credit is not received. Greg Howard Auction Service may ask for the bank letter of credit on a per bidder and/or per property basis. Greg Howard Auction Service, Gatewood Realty & Associates shall have the permission and authority to charge 10% (with a cap of $5,000.00) of the high bid on a specific property to the credit cards of any active bidders on that specific property. This will only apply to bidders who are participating on the last day of the auction. This is a way of verifying the card will process the mandatory fee that is due form all high bidders. If you are not a high bidder on the last day we will credit the fee back to your credit card after the conclusion of the auction. The winning bidders credit card will be charged 10% of their high bid at the end of the auction for each property in which they are the high bidder on. This initial charge will be capped at $5,000.00 per property. BUT the 10% buyer's premium will still be applied to the high bid. There is no cap on the buyer's premium. This charge WILL NOT be refunded if the high bidder does not close on the property. This charge will then be credited back the buyers credit card once their 10% earnest money check has been received Greg Howard Auction Service will not be able to access or view any personal information and/or credit card information of any registered bidder.
